Terms of Service
Plain language. No surprises. You own your data.
Agreement
These Terms of Service ("Terms") are a legal agreement between you and HXA Labs LLC ("we," "us," "our"), a Wyoming limited liability company, the company behind DevSafe. By using DevSafe, you agree to these Terms.
If you do not agree, do not use the service. It is that simple.
"The Service" means the DevSafe software (CLI tool), website (devsafe.com), documentation, APIs, and any related services provided by HXA Labs. It does not include third-party cloud storage providers you connect to DevSafe.
DevSafe is a command-line tool that creates encrypted backups of your git repositories. It uploads those backups to cloud storage that you own and control. We do not host your data. We do not hold your encryption keys.
Your Account
You need an account to use DevSafe beyond the free tier. When you create one, you agree to:
- Provide accurate information.
- Keep your login credentials secure.
- Tell us if someone accesses your account without permission.
You are responsible for everything that happens under your account. Individual accounts are for one person. Sharing login credentials is not allowed. Enterprise plans may include team accounts with multiple seats.
You must be at least 16 years old to use DevSafe.
The Service
DevSafe is a CLI tool that:
- Discovers git repositories on your machine.
- Creates atomic git bundles of each repository.
- Encrypts those bundles on your machine using AES-256-GCM.
- Uploads encrypted bundles to your own cloud storage (Cloudflare R2, AWS S3, Backblaze B2, or any S3-compatible provider).
- Restores repositories from those encrypted bundles when you need them.
DevSafe runs on your hardware. Encryption happens on your machine before anything touches the network. We never see, store, or process your source code.
We may update, modify, or discontinue features at any time. We will give reasonable notice for changes that affect paid plans.
Your Data
The short version You own your data. All of it. Your source code, git history, configuration files, and encrypted backups belong to you. DevSafe does not claim any ownership or license to your data. Not now. Not ever.
Your encrypted backups are stored in cloud storage accounts that you own. We do not have access to those accounts. We cannot read, copy, share, or delete your backups.
If you stop using DevSafe, your backups remain in your cloud storage. They are standard git bundles encrypted with your key. You can decrypt and restore them without DevSafe using standard tools.
We do not sell your data. We do not use your data for training. We do not share your data with third parties. See our Privacy Policy for details on what limited data we do collect.
Encryption Keys
Your responsibility You are responsible for your encryption keys and recovery phrase. We never see, store, or transmit them. If you lose both, your encrypted backups are permanently inaccessible. No one can recover them. Not us. Not your cloud provider. Not anyone.
When you set up DevSafe, the tool generates a 256-bit encryption key on your machine. This key is stored in your system keychain. You also receive a recovery phrase that you should store offline in a safe place.
We cannot decrypt your backups. This is a deliberate design decision. It means we cannot help you if you lose your key. It also means no one else can access your data.
You accept full responsibility for safeguarding your encryption key and recovery phrase. HXA Labs is not liable for any data loss resulting from lost, forgotten, or compromised keys. This is the fundamental tradeoff of client-side encryption: maximum privacy requires maximum responsibility.
Keep your recovery phrase safe. Print it. Write it down. Store it somewhere you will not lose it.
Pricing and Payment
DevSafe offers four plans: Free, Pro, Team, and Enterprise. Every plan includes all DevSafe products. There is no per-product pricing. Current pricing for each plan is published at devsafe.com/pricing. All plans include AES-256-GCM encryption and free restore.
Paid plans are billed in advance on a monthly or annual basis. You can cancel at any time. Cancellation takes effect at the end of your current billing period. We do not offer partial refunds for unused time.
Free trials. If you start a free trial, it lasts 14 days. You will not be charged during the trial. At the end of the trial, your plan reverts to the Free tier unless you choose to subscribe. We will remind you before the trial ends.
We may change pricing with 30 days notice. Price changes do not apply to your current billing period.
Cloud storage costs are separate. You pay your cloud provider directly for the storage your backups use. DevSafe does not charge egress fees.
Acceptable Use
You agree not to use DevSafe to:
- Break any law or regulation.
- Store or transmit malware, ransomware, or other malicious code intended to harm others.
- Interfere with or disrupt the service for other users.
- Attempt to bypass plan limits or usage restrictions.
- Reverse engineer the DevSafe CLI for the purpose of creating a competing product.
- Use automated systems to create accounts or abuse the free tier.
DevSafe backs up whatever git repositories are on your machine. We cannot see the contents of your encrypted backups. You are responsible for the legality of the content you back up.
Intellectual Property
DevSafe, including the CLI tool, documentation, website, design system, and brand assets, is the property of HXA Labs. Patent applications are pending.
The DevSafe CLI is source-available software. You may view the source code for transparency and security auditing. The license does not grant rights to redistribute, modify for commercial use, or create competing products from the source. The full license is included in the repository.
Your use of DevSafe does not grant you any rights to our trademarks, logos, or brand materials beyond what is needed to use the product normally.
Your code is yours. Our tool is ours. These terms do not transfer ownership in either direction.
The on-disk backup format (encrypted git bundles) is documented and open. You are free to build tools that read this format.
Termination
You can stop using DevSafe at any time. Cancel your account through the CLI or by contacting us.
We may suspend or terminate your account if you violate these Terms. If we do, we will tell you why unless doing so would violate the law or put others at risk.
When your account is terminated:
- Your DevSafe license is revoked.
- Your encrypted backups remain in your cloud storage. We do not touch them.
- You can still decrypt and restore your backups using your encryption key and standard tools. No DevSafe account is needed for that.
We will not hold your data hostage. Your backups are yours before, during, and after your relationship with us.
Disclaimers
DevSafe is provided "as is" and "as available."
We work hard to make DevSafe reliable. But we cannot guarantee that:
- The service will be available 100% of the time.
- Backups will always complete successfully.
- Restored repositories will be identical to the original in every case.
- The service will be free of bugs or errors.
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
DevSafe is one layer of protection for your code. It is not a replacement for git remotes, version control best practices, or a complete disaster recovery plan. Use it alongside other tools, not instead of them.
Limitation of Liability
To the maximum extent permitted by law, HXA Labs is not liable for any indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost data, business interruption, or any other damages arising from your use of DevSafe.
Our total liability for any claim related to DevSafe is limited to the amount you paid us in the 12 months before the claim arose. If you are on the free plan, our total liability is $0.
This limitation applies whether the claim is based on warranty, contract, tort, or any other legal theory.
Some jurisdictions do not allow these limitations. In those jurisdictions, our liability is limited to the minimum extent permitted by law.
Changes to Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page.
For material changes, we will notify you by email at least 30 days before they take effect. If you do not agree with the new terms, you can cancel your account before they take effect.
Continuing to use DevSafe after updated Terms take effect means you accept them.
Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law provisions. Any disputes will be resolved in the state or federal courts located in Wyoming.
Before filing a lawsuit, you agree to try to resolve the dispute informally by contacting us first. Most issues can be sorted out with a conversation.
Data Processing
If you are located in the European Economic Area and require a Data Processing Agreement (DPA) for GDPR compliance, contact us. We will provide one.

Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets. If that happens, we will notify you in advance.
General
Severability. If any part of these Terms is found to be unenforceable, the rest remain in full effect.
Entire agreement. These Terms, together with our Privacy Policy and any plan-specific terms, are the complete agreement between you and HXA Labs regarding DevSafe. Marketing materials, blog posts, and website copy are not part of this agreement.
Waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
